General sale's conditions

1. PRICES AND TRANSPORT
   All the prices are stated in EURO CURRENCY, accessory charges excluded.Any price updatings are indicated once the invoice is issued and without any prior notice.
   Goods are sold EX – WORKS, PACKING EXCLUDED.
   They are sent at Buyer's charge and risk.Any claims must be addressed to the forwarding company which has takencharge of the goods.
2. PAYMENT CONDITIONS
   Payment term is settled with the Buyer at the time of purchase order.
   Payment cannot be suspended also if there are goods' claims.Until the goods are not paid for their entire value, they still belong to D.T.M. Ricambi s.r.l.
3. DELIVERY
   D.T. M. Ricambi s.r.l. does not take the responsilbility upon itself about delivery term.The date stated has an approximate value.Should more than 90 days' shipment delay occur, the Buyer can cancel his order by sending a REGISTERED LETTER.
   The Seller will not owe any reimbursement or indemnity if the purchase order is cancelled of if the Selling Company finds itself unable to carry out the supply for reasons beyond its control.
4. REFERENCES TO CODES
   Spare parts which make part of "STAR" exclusive, though they are not genuine they are interchangeable with genuine ones.Manufacturer's reference numbers have only an indicative purpose.
5. GUARANTEES AND CLAIMS
   Should there be any goods claims, the Selling Company must be informed by a written notice. Only after our authorisation, the goods, if that is the case, can be returned. If after our technical checking, the items should turn out to be faulty, our guarantee is bounded to the replacement to the faulty ones, without any reimboursement for possible damages caused by the item itself.
6. COMPETENT COURT OF JUSTICE
   For any disputes between Seller and Buyer, the Court of Justice expressly agreed to be competent is the one of Bologna, Italy. Should sales to foreign or living abroad citizens be carried out, the parties concerned expressly agree upon the Italian Law to be ruling their business relationship, also appointing Italian Authorities in case of controversy.
